Where possible we always seek for an agreement to be reached without the necessity to attend court, as this can add strain for all parties. However, if this is not possible our offices are experienced litigators and will provide you with the best representation available in the District Court, Circuit Court or High Court.
If you have found yourself experiencing marital or relationship breakdown, the time to seek legal advice is now. Our Firm will be able to look at your situation and assess and advise you as to what your next steps ought to be
Separation Agreements
Divorce/Judicial Separation Orders
- Divorce Proceedings can be initiated in the Circuit Court or High Court and will deal with matters to include but not limited to the following:
- The Family Home
- Pensions
- Provisions for any other properties held
- Details of living arrangements for any dependant children
- Other Access Arrangements
- Maintenance payments to include lump sum or periodic maintenance
Breaking up can be difficult but the issue of the division of property and assets and the issue of access and maintenance can be facilitated by a Separation Agreement. These Agreements are negotiated between solicitors and set out the terms of all matters of the parties separation.
When an agreement is reached, a document known as “Deed of Separation” will be signed and both parties will be legally bound to this agreement.
Conveyancing Service
What is conveyancing?
Conveyancing is the legal process of transferring the ownership of a property from one party to another. In Ireland, the conveyancing process can be complex, involving several different steps and legal requirements.
Appointing a Solicitor
The first step in the conveyancing process is to appoint a solicitor to act on your behalf. Your solicitor will guide you through the process, from the initial offer to the final completion of the sale.
Drafting and Exchanging Contracts
Once you have found a property that you wish to purchase, you will make an offer to the seller. If your offer is accepted, your solicitor will begin the process of drafting and exchanging contracts. This involves negotiating the terms of the sale and ensuring that all legal requirements are met.
Registration and Tax Implications
Your solicitor will also register the sale with the Property Registration Authority, ensuring that you are the legal owner of the property. Throughout the conveyancing process, your solicitor will also advise you on any tax implications or stamp duty payments that may be required. They will also liaise with your mortgage provider to ensure that all necessary paperwork is in order.
It is important to note that the conveyancing process in Ireland can take several weeks to complete. This is due to the legal requirements and checks that must be conducted to ensure that the sale is legally sound. However, with the support and guidance of an experienced solicitor, the process can be smooth and stress-free.
